Colorado is already a great state for surrogacy and it’s now even better. The Colorado Surrogacy Agreement Act went into effect on May 6, 2021, which establishes requirements for legally enforceable surrogacy agreements. Until this law was passed, Colorado had no surrogacy law on the books and Colorado courts typically relied upon established case law.

The law has several provisions which include:

  • Eligibility and criteria for surrogacy agreements. Specifically, under the law a surrogate must:
    • be 21 years old or older
    • have previously given birth to a child
    • undergo a medical evaluation and mental health counseling
    • have independent legal counsel of her choosing, licensed in the state, throughout the arrangement.
  • Procedures for obtaining court orders recognizing and enforcing surrogacy agreements.

The law also explicitly provides that parental rights for the intended parents vest immediately on the birth of the child, and the surrogate and her spouse have no parental rights. This will allow the parents to be placed on the birth certificate. However, a court order will still be required before the delivery before a birth certificate can be issued.

Judith Hoechst, a Colorado assisted reproductive technology attorney, was part of the team leading the effort to pass the new law. After almost dying giving birth to her first child, Judith used a surrogate to complete her family. “Loving families are formed in many ways, among them, surrogacy. Because of my son’s birth it was important to me to work to codify best practices and balanced protections for Colorado parents and surrogates. Is Surrogacy in Colorado Legal?

Yes, per state law, surrogacy in Colorado is legal. Gestational surrogacy is explicitly permitted in Colorado by the Colorado Surrogacy Agreement Act. This law supports parents that are single, unmarried or married, and of any sexual orientation. Intended Parents may use their own sperm or eggs or a donor, or they may use an embryo that is unrelated to them. Under the new law, Intended Parents are able to petition the juvenile court before the birth to obtain an order that allows them to have their names placed on their child’s birth certificate at the time of birth. If the Child is born in Colorado, vital records will issue a birth certificate that lists the names of the Intended Parent(s) as the parent(s) of their child.
