There are several elements at play here. It is no secret that certain states provide a more amenable venue for surrogacy arrangements than others. Indeed, the state in which a surrogate lives, and thus, where her surrobaby is delivered, can have a monumental effect on the legal action required to secure parentage. So it makes sense then that some agencies offer compensation based on an applicant’s home state.
