Yes. Texas authorizes gestational surrogacy by statute (Tex.Fam.Code § 160-751 through § 160-763) for married couples. Courts have commonly granted pre-birth orders for married couples regardless of their sexual orientation or genetic relationship to the child, provided that the Gestational Carrier Agreement is validated by a court prior to the child's birth. Some judges have allowed single individuals and unmarried couples to obtain pre-birth orders.
